Wise Kids Academy Terms of Use

1. About Wise Kids Academy

Wise Kids Academy (“WiseKids”, “we”, “us” or “our”) is operated by Daniel Bruno Dewes, trading as Wise Kids Academy, Brestenbergstr 14, 79211 Denzlingen, Baden-Württemberg, Germany. Email: hello@wisekids.academy.

WiseKids provides educational stories, reading activities, quizzes, progress tracking and related learning tools for families, teachers, schools and children.

2. Using WiseKids

Some parts of WiseKids may be browsed without signing in. Other features require an adult account, family subscription, teacher account or school-controlled pupil access. Children should not create adult accounts or provide their own email addresses in order to use the child-facing parts of WiseKids.

3. Family accounts

Family accounts are intended for personal and household use. A family account may currently have up to five active child profiles. Adults are responsible for keeping account access secure and managing child profiles appropriately. Accounts must not be sold, transferred or deliberately shared in a way intended to bypass WiseKids access or subscription limits.

4. Subscriptions

WiseKids currently offers family subscriptions at US$5 per month or US$42 per year. Both plans currently include a 14-day free trial. A payment method is required when starting the trial, but $0 is due when the trial begins.

Unless cancelled before the trial ends, the selected subscription is intended to begin charging automatically at the end of the trial. Subscriptions then renew according to the chosen monthly or annual billing period unless cancelled. Payment processing is provided by Stripe.

Prices, plans and features may change in the future. Where a change materially affects an existing paid subscription, WiseKids will provide appropriate notice where required.

5. Cancelling a subscription

A family subscription may be managed through the available WiseKids/Stripe subscription-management process. Cancellation normally stops future renewal while allowing any already-paid or trial access to continue for the applicable period, subject to the subscription status shown through the service.

An adult WiseKids account cannot currently be permanently deleted while its associated family subscription is active, trialling or past due. Automatic Stripe cancellation as part of WiseKids account deletion is not currently implemented.

6. Consumer rights

Nothing in these Terms removes or limits mandatory consumer rights that apply under the law. Depending on where you live, you may have statutory rights relating to online contracts, digital services, cancellation, refunds or withdrawal. Where those rights apply, they take priority over any conflicting provision in these Terms.

7. Free and preview content

WiseKids may make selected stories or other content available without a paid subscription. Availability of free, preview, sample or promotional content may change. Unless specifically stated otherwise, access to free content does not guarantee permanent access to that particular content or feature.

8. School and teacher use

Schools and teachers may use WiseKids under separate arrangements, including pilot or beta arrangements. School pupil access is intended to be controlled by authorised teachers or schools rather than through pupil email accounts. Where WiseKids processes pupil information on behalf of a school, additional privacy and data-processing terms may apply.

A family subscription does not by itself create a school licence or authorise institutional use. School billing is not currently implemented.

9. Educational purpose

WiseKids is intended to support reading, discussion, comprehension, reflection and related educational activities. It is not intended to replace professional educational assessment, safeguarding responsibilities, specialist educational support or the judgement of parents and teachers. Quiz scores and progress information should be treated as learning-support information rather than formal educational certification or diagnosis.

10. Artificial intelligence

WiseKids uses the OpenAI API for some educational and story-related content generation. AI-generated material can occasionally contain mistakes, incomplete information or unsuitable wording. Adults and teachers should use appropriate judgement when relying on generated educational content. WiseKids does not currently use OpenAI to make important automated decisions about individual children.

11. Acceptable use

Users must not use WiseKids to break applicable law, attempt unauthorised access, interfere with security or operation, bypass subscription restrictions, systematically scrape or copy the service without permission, introduce malicious software, impersonate another person, misuse pupil or child information, or use the service in a way that could harm children or other users.

We may restrict or suspend access where reasonably necessary to protect users, the service or other people.

12. Content and intellectual property

Unless stated otherwise, WiseKids software, branding, layouts, original educational materials, generated companion materials and other WiseKids-created content are protected by applicable intellectual-property rights. A subscription gives users permission to use WiseKids through the service for its intended personal or educational purpose. It does not transfer ownership of WiseKids content or software.

Some stories or source materials may be based on public-domain works or other material with separate rights. Rights in those underlying works remain subject to their own legal status.

13. Availability and changes

WiseKids is still developing and may be updated over time. We may add, change or remove features where reasonably necessary for product development, security, legal requirements or service operation. We will try not to make changes that unfairly remove the essential value of an active paid subscription without appropriate notice or remedy.

14. Account suspension or termination

We may suspend or terminate access where reasonably necessary because of serious or repeated breach of these Terms, fraud, security threats, unlawful activity, misuse involving children or pupil information, or non-payment where continued paid access is no longer appropriate. Where reasonable, we will try to provide notice and an opportunity to resolve the issue.

15. Privacy

Use of personal information is explained in the Wise Kids Academy Privacy Policy. A separate child-friendly privacy explanation is also available for younger users.

16. Liability

WiseKids will take reasonable care in providing the service. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights that cannot legally be waived under applicable consumer law. WiseKids is not responsible for losses caused by circumstances outside its reasonable control or by misuse of the service.

17. Governing law

These Terms are operated from Germany. German law will generally apply to the relationship between WiseKids and its users, without removing mandatory consumer protections available to consumers under the law of their country of residence where those protections apply. Separate agreements with schools may specify additional governing-law or jurisdiction arrangements.

18. Changes to these Terms

We may update these Terms when the service, commercial arrangements or legal requirements change. The date at the top will be updated when the Terms change materially. Where reasonably required, existing account holders will receive notice of material changes.
